Deputy Lyman was dispatched to a report of trespassing, and dispatch reported that the male subject was on the property going through items and was now hiding in the porta-potty.

On the way to the scene, Deputy Lyman contacted the complainant and was advised that 24-year-old Melvin Aliso Martene Cesspooch was not supposed to be on the property and had entered a building he was not supposed to be in. Deputy Lyman arrived on the scene shortly after Sgt Watkins and Officer Foster.

Sgt Watkins was standing near the porta-potty, asking Melvin to come out. Deputy Lyman walked over to their location as Melvin exited, crushing up a Budweiser can and then throwing it on the ground.

Melvin was placed in handcuffs, and after he was taken into custody, Sgt Watkins began searching Melvin's person. Sgt Watkins felt something in Melvin's pocket and asked what it was. Melvin stated, "It's a weed pipe."

The complainant stated she had returned to the camper and located Melvin inside the camper, sitting on the couch, smoking marijuana. Deputy Lyman picked up the Budweiser can off the ground and observed marijuana plant material that was half burnt.

Melvin was transported to the Uintah County Jail, where he was booked on the charges of possession of a controlled substance (marijuana), a class B misdemeanor; Possession of drug paraphernalia, a class B misdemeanor; and criminal trespassing, a class B misdemeanor.
