Vernal, Ut.- On 3/24/23, at around 8:20 am, Deputy Fackrell was working in the jail's booking area when he heard Deputy Cox urgently call for the section door of Pod D.

Cpl Van Leuven asked for a safety check from Deputy Cox. Cox confirmed everything was under control.

Other Deputies conducted an investigation and watched the video footage. They discovered inmate 53-year-old Kim Ford Cuch and inmate Samudio, housed in Pod D, appeared to get into a verbal argument in the day room of Pod D. The argument escalated into a physical altercation with each other where Cuch shoved Samudio.

It appeared that Samudio attempted to avoid the altercation. Three other inmates also stepped in to isolate Cuch in Cell D10, which is Cuch's assigned cell, to de-escalate the situation.

Cuch seemed to wait for one of the other inmates to let go of him. Cuch then left his cell to re-engage Samudio in the Day Room of Pod D. Cuch then opened hand slapped Samudio in the head/neck area.

Words were being exchanged between Samudio and Cuch. Cuch entered cell D7 which is housed by inmate Samudio. Samudio attempted to lock Cuch in cell D7 to separate himself from Cuch.

Inmate Sumudio was unsuccessful in securing the door. Cuch exited cell D7, and the two had brief physical exchanges in the Day Room. At this time, all inmates were ordered to return to their cells by Deputy Cox at approximately 8:23 am.

After the Deputies viewed the video, other Deputies entered Pod D and informed Cuch that he would be moved to a different Pod. Cuch was placed into handcuffs and transferred to Pod F.

Deputies attempted to interview Cuch and Samudio, and both declined to make a statement.

Cuch was charged with assault by a prisoner.
