7/13/24

| Duchesne, Ut. | July 11th, 2024 |

At around midnight, Deputy Smith received a call about a domestic violence incident in the area of Starvation Lake. The victim reported that her ex-boyfriend, 40-year-old Daniel Paul Diaz, showed up at her home making threats, yelling, and screaming at her.

While the deputy was en route, dispatch updated the incident reporting they could hear Daniel yelling at the victim, saying, "Shut the fuck up, you better not call anyone."

Dispatch could hear the victim screaming, "Please help me!" multiple times.

When Deputy Smith arrived on the scene, he met with Daniel, attempting to get into his truck to leave. The deputy was informed that Daniel would be wearing a plate carrier and have five knives and two BB guns on his person.

Upon the investigation, it was learned that Daniel had a protective order against the victim. Daniel had gone to the victim’s home, violating his own Protective Order.

Daniel Diaz was arrested on assault with a protective order violation after he was arrested, a bong with a burnt residue consistent with meth or crack use.

The victim told Deputy Smith that Daniel had shown up at her home and had started yelling at her. Daniel would also get close to her and jab his finger into her chest multiple times.

The deputy had the victim take a lethality assessment, and during the assessment, Daniel scored high on being a threat to the safety and well-being of the victim.

Daniel was booked into the Duchesne County Jail at 2:35 a.m. and was later released.
