Roosevelt, Ut.-On 6/13/23, at around 6:00 pm, the complainant stated she had a male come into the restaurant to order some food. The complainant said the food the man ordered was ready, and she went to have the man pay for his meal. The man told her he already paid for it, but the complainant stated he didn't pay and left the restaurant.
While Officer Christensen was on his way, he saw a man walking on the side of the road next to the Frontier Grill with tattoos on his face. Officer Christensen spoke with the complainant and asked if the male if his face had tattoos. The complainant said, "Yes, he does."
The complainant filled out a statement while the Officer searched the male subject. The man was found at the Top Stop gas station getting something to eat. Officer Christensen asked if he was just at the Frontier Grill and ordered food. The man said, "He was but never got his meal."
Christensen asked if he paid for his meal, and he said he did not because he never got his food.
While speaking with the male, identified as 39-year-old Cody Allen Shirley, the Officer could smell alcohol coming from his person and spoke with a slurred speech. Dispatch confirmed Cody is an alcohol-restricted person and an interdicted person.
Cody was arrested and searched, and during the search of his backpack, the Officer found a glass pipe with a white crystal substance inside it. Officer Christensen also found three bottles of vodka in his backpack.
Cody was transported to the Uintah Basin Medical Center for medical clearance. While getting a medical clearance, Cody became very belligerent and was trying to get the police to fight with him.
They asked Cody multiple times to calm down and to have a seat so the nurse could get a reading of his vitals. Cody kept standing up and walking toward the police and wanting to fight.
After Cody received his medical clearance, he was transported to the Duchesne County Jail.
