A UHP Trooper was traveling East on US-40 when his radar read 81 mph in a 65 mph zone. The trooper pinpointed the speeding vehicle as a motorcycle quickly passing other traffic.
Trooper Carson turned around and stopped the motorcycle near milepost 139. He approached the driver, who was friendly, and told the officer that he was speeding and was test-driving the bike.
His Utah driver's license identified the driver as 28-year-old Jared Rae Holmes.
While attempting to find the owner, Jared said he didn't know who the owner of the bike was. During their conversation, the trooper noticed that Jared's body was fidgety, he couldn't control his feet, and he was becoming upset. His hand began to shake so much that he struggled to manipulate his phone and hold things in his hand.
The trooper returned to his vehicle to check Jared's information and learned that he didn't have an endorsement for operating a motorcycle. He admitted that he purchased the motorcycle but didn't register it.
Jared’s behavior began to change again from disrespectful to angry.
It was learned that the motorcycle's old registration had been canceled, and he showed the trooper a picture of the title signed over with no date.
Trooper Carson called Jared’s insurance agency, and they informed him they do not offer motorcycle insurance, confirming that the bike was uninsured.
Because of the circumstances, the trooper suspected Jared of operating the motorcycle under the influence and performed field tests with him.
Trooper Carson observed multiple signs and clues of impairment on all tests and didn't feel It was safe for Jared to operate a motor vehicle. He asked Jared if he had any history of drug use, and Jared stated he had recently used marijuana and had been a meth user.
At 3 p.m., Jared was placed under arrest, and the trooper read him the DUI admonitions, which he refused. Then, the refusal admonitions were read, which he also refused at first but then said he would consent.
Once at the hospital, Jared signed the consent form, and blood was drawn from his left arm. Throughout the interaction with Jared, he was unruly, aggressive, and disrespectful.
He was then transported to the jail and booked on his charges.
