Officer gives an intoxicated male a ride home, later sees the same man driving

While Officer McGaha was out on patrol, he received a call for a possible suicide threat. Dispatch notes from the complainant follow:


Joshua D McCurry - is really drunk - took her car and was driving it - the caller was able to take back her car, and he stepped out and said he was going to kill himself - 31 yr old male white, 5'10, red beard, maroon t-shirt jeans boots, and a hate - neg injuries at the moment - states he might have a knife on him but isn't sure, said he would slit his throat.


Upon arriving in the area of 1350 S and 1500 E in Naples, Officer McGaha saw the described male walking northbound on 1500 East. He was walking unsteadily, stumbling as his feet were weighted down.


The officer turned around and stopped to talk with the man, later identified as 31-year-old Joshua D McCurry.


Officer McGaha noticed Joshua’s eyes were bloodshot and glossy, his speech was slurred and repetitive, and there was a distinct odor of alcohol coming from his breath during their conversation.


Joshua stated he wasn’t suicidal and had no intentions of harming himself or others. When asked how much alcohol he had consumed, he replied that he had drunk almost a fifth of alcohol.


The officer then asked if he would like a ride home, and he agreed. Joshua was cooperative while the officer assisted him in the backseat of the patrol vehicle. Officer McGaha took Joshua to his residence and spoke with him about going inside and refraining from further activities for the day.


After ensuring he was safe, Officer McGaha cleared the scene and returned to Naples.


While Officer McGaha was on 500 South near 700 East, he noticed the complainant with a male who resembled Joshua McCurry.


The officer pulled into the parking lot at 716 East and saw Joshua seated in the driver’s seat of a white Ford truck with the engine running. Officer McGaha approached the truck, Joshua looked back, quickly got out of the truck, and locked it.


The officer told Joshua he was under arrest, and he responded by asking, for what? Joshua was directed to the truck's bed, and the officer put his weight against him to maintain control. Officer McGaha requested additional units to assist because Joshua began to resist arrest.


Joshua tensed his arms, kept his right hand out of reach, and attempted to pull his left hand away from the officer. Officer McGaha managed to gain control of his left hand and secured it with a handcuff.


Joshua repeatedly stated he wanted to talk about it, and the officer stated he was under arrest and demanded that he give the officer his right hand, but Joshua continued to resist. Even the complainant urged him to stop resisting and comply.


Although Joshua was verbally compliant at times, he continued to actively resist arrest. After gaining control of Joshua and securing him in handcuffs, and searched. The officer didn’t find a key to the Ford. Joshua stated he didn’t have it in his possession.


The complainant informed Officer McGaha that Joshua had handed her the truck key when the officer arrived just after he locked the vehicle.


Joshua D McCurry was taken to jail, and a BAC was performed. The results were .188.


Joshua Mccurry may post bail in the amount of $2,140.00.
