Police arrest a male at Silver Pines apartments for domestic violence

Vernal City Police responded to an unknown 911 detail at the Silver Pines apartments complex at 165 East 760 South.


The complainant reported he received a text from the Victim, and the complainant reported that the Victim was at 31-year-old Joshua Dakoda Quinn McCurry's residence and needed the police now.


When Cpl. Ross arrived on the scene and stood outside the front door, he could hear a female screaming in distress. The police kicked in the door, and Joshua was walking toward the officer.


Joshua was placed in handcuffs and double-locked, then escorted out of the residence.


Cpl. Ross then spoke with the Victim, who was visibly upset. She stated she had been dating Joshua for about six months. The Victim stated she came to check on Joshua because he had been drinking and had gotten upset, and began yelling and screaming at her.


At one point, Joshua passed out in the bathroom, and when he regained consciousness, he began throwing shower curtain rings at the Victim. The Victim stated Joshua took away both of her phones and threw them off the third-story balcony.


The Victim stated she attempted to leave the apartment multiple times, but Joshua would not allow her. She said this went on for approximately two hours.


Joshua retrieved one of the phones and began going through the stored contents. Joshua stated he was going to send intimate photographs between himself and the Victim, to the Victim's family members if she broke up with him. If she promised not break up with him he would not send the pictures.


The Victim stated she was able to get a phone back and made it appear that she was calling 911, causing Joshua to get more upset. He then began pushing the Victim and grabbed onto the Victim's arms, forcing them behind her back. Joshua continued to push and throw the Victim around physically.


The Victim was able to contact someone for help before being slammed to the floor. Cpl. Ross saw the Victim with red markings on her right forearm and a red mark on her right cheek.


Joshua stated he took the Victim's phone but gave it back after she gave his phone back. He said he drank three to four drinks and had pushed the Victim to get her away from him. Joshua was informed that he was under arrest for domestic violence charges, and he was transported to the Uintah County Jail.


Cpl. Ross stated in the affidavit that Joshua had used unlawful force against the Victim while also damaging/interrupting the communication device of the Victim as she was attempting to summon emergency aid.
Joshua then attempted to coerce the Victim to remain in a relationship with him by threatening to distribute an intimate image or video of the Victim. As the Victim attempted to leave the residence for two hours, Joshua would not allow her to leave as he stood in the doorway or restrained her by forcing her arms behind her back.
Joshua was under the influence of a substance to the degree that he was a danger to himself and others. Joshua recklessly engaged in behaviors that caused annoyance and alarm by engaging in fighting or violent, tumultuous, threatening behavior.
I determined I had probable cause to arrest Joshua McCurry with the following:

- Sexual Extortion – Domestic Violence

- Unlawful Detention – Domestic Violence

- Assault – Domestic Violence

- Damage / Interrupt a Communication Device – Domestic Violence

- Intoxication Disorderly Conduct
