Vernal Police Officer Webb responded to a domestic violence detail where three people were fighting.
A second call came in from a child saying adults were drinking and a man did something to a woman, and she didn't like it. The child stated that she saw the man grab the female by the head.
Deputy Pratt arrived and stated that a female and a male, identified as Victim 1 and Victim 2, were outside. He could see 46-year-old Carlos Chavez standing in the doorway.
The deputy stated Carlos closed the door and locked it. The deputy tried to open the door because he could hear fighting coming from inside the home.
Someone from inside the home unlocked the door, and the deputy entered the home. He instructed Carlos to stand up against the wall due to a knife being within the reach of Carlos.
Deputy Pratt observed a female, Victim 3, on the ground on some broken shelving. While the deputy was helping Victim 3, Carlos ran outside the back of the house.
Deputy Pratt, Deputy Russell, and Officer McDavid then cleared the rest of the house while Officer Webb helped Victim 3.
The child who called 911 stated that Carlos had victim 1 in a chokehold on multiple occasions while touching her face. The child stated after that, everyone started fighting, but the fight was only between Carlos, his friend, and Victim 2.
The child stated that Carlos pushed her mother, Victim 3, into the shelving unit.
Victim 4 stated that she attempted to separate Carlos and Victim 2. Victim 4 stated that at some point, Carlos pinned her up against the wall outside. Victim 4 stated that Carlos had pushed Victim 3 into the shelving unit while he was attempting to close the front door when Deputy Pratt arrived.
Victim 2 stated that he could hear his wife, victim 1, yelling from the front of the house. Victim 2 said that Victim 1 was yelling that Carlos tried to rape her. Victim 2 stated that he got Victim 1 and their two children out of the house, and he saw Carlos holding Victim 4 up against a wall. Victim 2 stated that he attempted to get Carlos to stop, and Carlos began pulling on his shirt. Victim 2 stated that he wasn't sure what exactly happened after that.
Victim 1 stated that Carlos grabbed her buttocks and vagina over her clothes. Victim 1 stated that Carlos also came up behind her, put his hand over her mouth, and ran his other hand up and down her chest under her shirt. Victim 1 stated that Victim 2 began fighting with Carlos to try and get Carlos off of her.
On 11/28/24, Carlos Chavez was arrested and booked for domestic violence-related charges.
While Deputy Murrieta booked Inmate Chavez in, Deputy Jensen witnessed Deputy Murrieta explain the Jail Release Agreement (JRA) to Inmate Chavez and instruct Inmate Chavez to read out loud the following statement to ensure comprehension of the situation.
"Having been arrested for domestic or a qualifying offense as defined in Utah code, I understand that if I knowingly violate this agreement, I will be guilty of a third-degree felony if I was originally arrested for a felony or I will be guilty of a Class A misdemeanor if I was originally arrested for a misdemeanor."
Once Inmate Chavez read the statement out loud, he stated he understood the JRA and signed it, stating he would not violate it.
After Inmate Chavez signed the JRA, Deputy Murrieta allowed Inmate Chavez to use the phone. Inmate Chavez was on the phone for approximately 5 minutes when Deputy Jensen heard Inmate Chavez say the listed victim's name on the phone call.
Deputy Jensen instructed the inmate to hang up the phone and go back to his cell. After reviewing the phone call, the deputy discovered that Inmate Chavez had violated the jail agreement.
When Inmate Chavez began the phone call, Inmate Chavez stated I love you. The female victim responded We have been together for 17 years. Inmate Chavez referred to this female victim as Babe. At the end of the phone call, Inmate Chavez says the name of the listed victim on the JRA while speaking with her.
For these reasons, Deputy Jensen saw probable cause in charging Inmate Chavez with violation of a protection order.
