While patrolling Myton City, Cpl. Cox observed a known drug user go to a couple of different drug houses.
After seeing 64-year-old Mike Lee Johnson leave another residence known for drugs, the deputy saw him driving West on 100 North toward 100 East. Mike slowed down for the stop sign, but not to a complete stop, and continued West.
Cpl. Cox got behind the vehicle, activated his emergency lights, and stopped the vehicle at 100 West 100 North.
The deputy approached the vehicle, told Mike the reason for the stop, and asked why he was going to known drug areas where other probationers live.
Mike claimed he wasn't going anywhere for drugs, and his passenger said she was friends with someone who lived at one of the houses.
The deputy advised Mike that he had spoken with his parole agent, who requested that the deputy conduct a compliance check. The deputy asked the two if any of them had anything illegal on them. They both stated they did not, and the female gave Cpl. Cox consent to search her.
Mike was asked when the last time he used any drugs, and he replied that it was a long time ago. Cpl. Cox asked what was a long time ago, and he said two weeks.
The deputy had them both exit the vehicle, searched them, and then had them stand in front of the patrol vehicle.
Before the search, Mike asked if he could get his jacket, and the deputy told him he would get it for him. Mike also wanted one for the female passenger and he started walking quickly toward the driver's seat and reached into the vehicle.
Cpl. Cox watched Mike closely as he grabbed his wallet, took something out, and quickly moved away. Mike was asked what he had just taken and told to show his hands. The deputy could see something green in one of his hands, and Cpl. Cox told Mike to give it to him. Mike said "No" and started to become agitated. The item Mike had was a small clear baggie with a white crystal substance consistent with meth.
Mike asked Cpl. Cox asked if he was going to jail now, and the deputy replied that he was and placed him into handcuffs.
Mike was read his Miranda Rights and asked to be honest with the deputy about when he last used meth. Mike said two weeks, and the Corporal said he didn't think he was being truthful. Mike then said five days ago.
After completing the search of the vehicle, Mike was transported to the hospital to submit to a chemical blood test for DUI metabolite. A nurse successfully drew two vials of blood from Mike's body, which were sealed to be sent for testing.
Mike received a medical clearance and was transported to the Duchesne County Jail and charged with driving under the influence of a metabolite, possession of controlled substance meth, a third-degree felony for a prior felony drug conviction in 2024, possession of drug paraphernalia, tampering with evidence as he attempted to remove evidence knowing that the deputy would be searching and hide or destroy it, and driving on a suspended license.
